Welcome to SmartHabitat Modular. These Terms of Service ("Terms") govern your access to and use of our website, as well as the engineering, manufacturing, and consultation services related to our smart modular homes in Canada.

1. Acceptance of Terms

By accessing this website, requesting a project estimate, or communicating with our engineering team, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue use of our site and services immediately.

2. Services Provided

We provide comprehensive modular housing solutions, which include but are not limited to:

• Architectural drafting and custom OEM/ODM engineering modifications.
• Off-site manufacturing of steel-framed modular structures.
• Integration of low-voltage IoT networks and smart home technologies.
• Consultation regarding Canadian municipal zoning, CSA standards, and the National Building Code of Canada (NBC).

3. Estimates and Contractual Agreements

Any project estimate provided via our contact form is for informational purposes only and does not constitute a binding legal contract. Final pricing, manufacturing timelines, and site delivery protocols will be outlined in a separate, formal Manufacturing and Sales Agreement signed by both parties after architectural review.

4. Intellectual Property Rights

Unless otherwise stated, SmartHabitat Modular and/or its licensors own the intellectual property rights for all material on this website, including but not limited to structural blueprints, 3D renderings, text, and source code. You may access this material for your own personal, non-commercial use, subject to restrictions set in these terms. You must not republish, sell, reproduce, or duplicate our proprietary engineering designs.

5. Limitation of Liability

In no event shall SmartHabitat Modular, nor any of its officers, directors, and employees, be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website. Our liability regarding the physical manufacturing and installation of modular units will be strictly governed by the distinct warranty terms provided in your final purchase contract.

6. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising in relation to these Terms will be subject to the exclusive jurisdiction of the provincial and federal courts located in Toronto, Ontario.
